January 27, 2017-Land Use Bylaw Review and Update

Please be advised that MD of Bighorn Council directed that the  MDs Land Use Bylaw be updated.  As part of this project, we have several consultation sessions planned with MD residents and businesses.  The first round of consultation sessions is planned for March 2017 to identify any issues that could be addressed in the Land Use Bylaw update. 

Project updates, including consultation session dates, will be posted on the MD website and social media platforms, and advertised in the local papers.  We look forward to working with the community on this project!

MGB Decision March 2, 2017 re: Dead Man’s Flats Area Structure Plan- MGB Appeal

MUNICIPAL GOVERNMENT BOARD DECISION ON INTERMUNICIPAL DISPUTE

TOWN OF CANMORE/MUNICIPAL DISTRICT OF BIGHORN (MGB FILE 15/IMD-002).

 

The Municipal District of Bighorn (the M.D.) has been advised of the Municipal Government Board (the MGB) decision on the intermunicipal dispute between the M.D. and the Town of Canmore. The M.D. respects the authority of the MGB in this matter, and appreciates the Boards diligence in reviewing all information and testimony in reaching its decision.

The M.D. is satisfied that the MGB has determined there is no economic, environmental or social detriment to Canmore with the approval of the Dead Mans Flats Area Structure Plan (ASP).

The MGB decision will allow the M.D. to move forward with the next steps of the planning process on the eventual development of its Dead Mans Flats lands for light industrial purposes, while concurrently continuing land exchange negotiations with the Provincial government, for the same lands, a process that has been on-going since 2003, when the Wind Valley wildlife underpass was proposed as part of the Kananaskis G-8 Summit. As was noted to the MGB, the M.D.-owned lands at Dead Mans Flats were and are an integral part of the municipalitys sustainability for the future.

The M.D. will reach out to its municipal neighbour, the Town of Canmore, to move forward on strengthening our municipal relationship.  While disappointed that the Town unilaterally initiated the intermunicipal dispute approach to the MGB, the M.D. understands and appreciates the importance of the lands and environment surrounding the Town, and Canmores environmental stewardship. The M.D. also believes in strong environmental stewardship and despite the disagreement with the Town in the future development of lands at Dead Mans Flats, we are proud our on-going initiatives to protect and preserve important lands within the M.D.s boundaries. It should be noted that, out of the M.D.s total area covering 650,000 acres, nearly 210,000 of those acres are in Wildland Parks, Wilderness Areas, or Natural Areas, with another 290,000 acres as undeveloped forestry lands, where wildlife travel through unimpeded, inhabit, graze, etc. in short, five out of every six acres, in the M.D. of Bighorn, is either formally protected through designation, or otherwise held by the Crown as undeveloped lands readily accessible to and used by wildlife.

The M.D. will now move forward with amendments to our Municipal Development Plan and Land Use Bylaw, to redesignate and redistrict these lands from their long-standing uses (which include, but are not limited to, single family dwelling, campgrounds, commercial equestrian centres, country recreational lodges, logging, and cultural/entertainment facilities).  The approved Dead Mans Flats ASP will guide the future development of our municipal lands with appropriate policies for light-industrial uses.

On May 20th, 2016 the MD Bighorn made its submission to the Municipal Government Board regarding the Town of Canmore appeal of the Dead Man’s Flats Area Structure Plan. See a copy of the Written Submission and the Table of Contents from the submission. A copy of the MD’s full submission is available for the public to view at the MD office in Exshaw during regular business hours.

Notice of Public Hearing- February 21, 2017 Bylaw 01-Z/17-Proposal to Amend Land Use Bylaw 04/10

 

NOTICE OF PUBLIC HEARING

RE:                 BYLAW 01-Z/17, A PROPOSAL TO AMEND LAND USE BYLAW 04/10

DATE:            TUESDAY FEBRUARY 21, 2017, 7:00 P.M.

PLACE:         BEAUPRE COMMUNITY HALL, HIGHWAY 40 AND BEAUPRE CREEK RD, ROCKY VIEW COUNTY, ALBERTA

 

PURPOSE:

The purpose of proposed Bylaw 01-Z/17 is to amend Land Use Bylaw No. 04/10 by redistricting three (3) parcels: SE 23-26-7-W5M, SW 28-26-6-W5M and a Portion of NE 33-26-6-W5M, from Agriculture Conservation District (AC) to Small Holdings District (SH), as illustrated.  

 

 

REPRESENTATION:

Oral and written comments and suggestions are invited and should address the amendment proposal in draft Bylaw 01-Z/17.  The comments and suggestions may be made by any person or group of persons, or a person acting on his, her or their behalf, who claims to be affected by the proposed bylaw; and from any other persons whom, at the hearing, Bighorn Council wishes to hear. Technical Documents may also be submitted and may include, but are not limited to, engineering reports, consultants’ studies and other relevant documentation.

Written submissions may be made by the persons described above and must be received in the Municipal District of Bighorn No. 8 Municipal Office, #2 Heart Mountain Drive, P.O. Box 310, Exshaw, Alberta, T0L 2C0 by the dates as indicated below:

 

  • Technical Documents and other written submissions in support of the proposed bylaws must be received no later than 4:30 p.m., February 7, 2017.
  • Technical Documents and other written submissions which are not in support of the proposed bylaws must be received no later than 4:30 p.m., February 14, 2017.

 

Oral presentations may be made at the hearing by individuals or groups (as described above), whether or not they have submitted a written presentation.  Oral presentations should be limited to five (5) minutes at each hearing.

Copies of proposed Bylaw 01-Z/17, the MD of Bighorn Land Use Bylaw No. 04/10, and public hearing procedures may be accessed on the MD’s website at www.mdbighorn.ca and are available for public viewing at the MD of Bighorn Office in Exshaw during regular working hours.  Technical Documents and similar written documentation, letters and other written submissions may be inspected after the key dates noted above at the MD of Bighorn office.
